Evolve Prefabrication Pty Ltd (ACN 37 637 675 337) ("Evolve") recognise the importance of protecting your personal information is important. This Privacy Policy sets out our commitment to protecting the privacy of personal information provided to us, or otherwise collected by us, offline or online, including through our services and website (Services). In this Privacy Policy we, us or our means Evolve and its related entities.

This Privacy Policy outlines the personal information Evolve may collect from you. This may also occur when you visit Evolve’s factories in Victoria. This Privacy Policy further explains how Evolve will use your personal information and what to do if you do not want your personal information collected or shared. For these reasons, we encourage you to read this Privacy Policy carefully.

Application of Law:

Evolve is bound by the Australian Privacy Principles (APPs) contained in the Privacy Amendment (Enhancing Privacy Protection) Act 2012, which amends the Privacy Act 1988 (Cth).

The laws of Australia shall apply to the collection of personal information through the Evolve hosted or sponsored website and that provided by you at our factory, when you sign in. 

Glossary

Where we refer in this policy to your ‘personal information’, we mean any recorded information that is about you and from which you can be identified. It does not include data where your identity has been removed (anonymous data).

Where we refer to the ‘processing’ of your personal information, we mean anything that we do with that information, including collection, use, storage, disclosure, retention or deletion.

When we refer in this Privacy Policy to weus or our it means Evolve and its related entities responsible for processing your data.  Evolve is the controller and responsible for this website.

We have appointed a data protection officer (DPO) who is responsible for overseeing questions in relation to this privacy notice, as part of our Information Compliance Team. If you have any questions about this privacy notice, including any requests to exercise your legal rights, please contact the DPO using the details set out below.

Glossary Protection of Information 

Protecting your information is of primary importance to Evolve and any information that is collected, is stored on secure servers and Evolve takes all reasonable precautions to protect that personal information.

However, no data storage or data transfer system is 100% secure, error-free or free from vulnerabilities. Evolve cannot guarantee the security of our databases or services. Evolve is not responsible for the actions of third parties.

Personal information we collect

Evolve collects data from you, through our interactions with you for a variety of purposes described below, including to operate effectively. You provide this data directly when joining the company as an employee or consultant or when we contract with you as a client, a supplier or a partner.

We rely on a variety of legal reasons and permissions to process data, including with your consent, necessity to enter into contracts and compliance with legal obligations, for a variety of purposes described below.

We also may obtain data from third parties. We protect data obtained from third parties according to the practices described in this statement, plus any additional restrictions imposed by the source of the data. These third-party sources vary over time and include:

  1. Suppliers of products and services to Evolve;
  2. Communication services, including email providers and social networks like Linked-in, when you give us permission to access your data on such third-party services or networks.
  3. Developers who do, will or may create new Evolve software and databases.

When you are asked to provide personal information, you can decline. Where we need to collect personal information by law or to enter into or carry out a contract with you, and you do not provide the data, we will not be able to enter into the contract.

Retaining your personal information

We will only retain your personal information for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

How we treat personal information and personal information that is also sensitive information

Evolve uses data to:

  1. Improve and develop our services.
  2. Recruit appropriately qualified and experienced personnel.
  3. Advertise and market positions within the Group.
  4. To use data to operate our business, which includes analysing our performance, meeting our legal obligations, developing our workforce and doing research.

Our processing of personal information for these purposes includes both automated and manual (human) methods of processing. When we process personal information about you, we do so with your consent and/or as required to provide services to you or to operate our business, meet our contractual and legal obligations, protect the security of our systems our clients and our partners or fulfil other legitimate interests of Evolve as described in this section and in the Reasons we share personal data section of this privacy statement.

We use data to detect and prevent fraud, resolve disputes, enforce agreements.

Sensitive information is a sub-set of personal information that is given a higher level of protection under the Australian Privacy Principles. Sensitive information means information relating to your racial or ethnic origin, political opinions, religion, trade union or other professional associations or memberships, philosophical beliefs, sexual orientation or practices, criminal records, health information or biometric information.

At the moment, we do not collect any sensitive information. If, in the future, we decide to collect sensitive information, then provided you consent, your sensitive information may only be used and disclosed for purposes relating to the primary purpose for which the sensitive information was collected.

Sensitive information may also be used or disclosed if required or authorised by law.

Third party and links to other websites

This Privacy Policy is directed and is applicable to individuals who visit those portions of the Evolve website accessible at www.evolveprefab.com.au, as well as and including any other Evolve websites or web pages accessible through the Evolve website or other promotional websites Evolve may host or may sponsor such as mini sites or pages on third party social networking sites, directed at clients and partners in Australia (collectively the “Sites”). If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any personal information to these websites.

This Privacy Policy applies only to information collected by Evolve via the Sites. We do not have any control over all those websites and we are not responsible for the protection and privacy of any personal information which you provide whilst visiting those websites. Those websites are not governed by this Privacy Policy.

Your rights

Under certain circumstances, by law you have the right to:

    1. Request access to your personal information (commonly known as a 'data subject access request'). This enables you to receive a copy of your data and to check that we are lawfully processing it.
    1. Request correction of the personal information that we hold about you. This enables you to have any incomplete or inaccurate information we hold about you corrected.
    1. Request erasure of your personal information. This enables you to ask us to delete or remove your data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your data where you have exercised your right to object to processing (see below).
    1. Object to processing of your personal information where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground. You also have the right to object where we are processing your personal information for direct marketing purposes.
    1. Request the restriction of processing of your personal information. This enables you to ask us to suspend the processing of your data, for example if you want us to establish its accuracy or the reason for processing it.
    1. Request the transfer of your personal information to another party.

Depending on the circumstances and the nature of your request it may not be possible for us to do what you have asked, for example, where there is a statutory or contractual requirement for us to process your data and it would not be possible to fulfil our legal obligations if we were to stop.  However, where you have consented to the processing (for example where you have asked us to contact you for marketing purposes) you can withdraw your consent at any time by emailing us at [email protected]. In this event, we will stop the processing as soon as we can. However, this will not affect the lawfulness of any processing carried out before your withdrawal of consent and you may no longer be able to use the site in the same way as you did before.

We will seek to deal with your request without undue delay, and in any event in accordance with the requirements of the law. Your complaint will be investigated by our Privacy Officer and you will receive a written or telephone communication within 28 days of receipt of your complaint.

Corporate change of control

Personal Information collected over the Sites may be transferred as part of any merger, acquisition or sale of company assets, as well as in the unlikely event of insolvency, bankruptcy, or receivership in which Personal Information would be transferred to another entity.

Changes to this Privacy Policy

Evolve reserves the right, in our sole discretion, to modify, alter or otherwise update this policy at any time and you agree to be bound by such modifications, alterations or updates.

Evolve will notify you of material changes to this Privacy Policy by posting the revised policy with the date it was revised on this page. Your continued use (including access, browsing and/or use of any interactive feature) of our Sites constitutes your agreement to this Privacy Policy and any updates.
